Man from Vadodara files petition for consumption of alcohol in private

Barodian Rajiv Patel along with Gandhinagar residents, Milind Damodar Nene and Niharika Abhay Joshi filed a petition before Gujarat High Court challenging the alcohol prohibition in the state.
They supported their petition by arguing that the Supreme Court already provides right to privacy and it’s also a constitutional right of freedom, so consumption of alcohol between four walls of the property is a private and an ‘act with self’ affair. Adding to that, liquor consumed in the privacy cannot harm or injure someone nor it can pose a threat to the security of society.
The petitioners’ advocate put forth an emphasis on the court that it must strike down sections 12, 13, 14-1B, 65 and 66 of the Prohibition Act as they are irrational and discriminatory and negate the principles of equality.
They also submitted a statement, stating, ‘Prohibition laws violate the petitioner’s right to privacy, right to life and personal liberty under Article 21 of the Constitution.’
The petition poses dichotomy to the prosecution law as it states that a person is liable for legal action in case of being found having liquor even in a house or at private places.
They also supported their petition by citing the historical tradition of its consumption during the Neolithic period.
