A few days back, the Vadodara District and Sessions Court had made the headlines with an interesting verdict, saying that if a married man has an affair outside marriage, it will be included in the domestic violence. At that time, we had a question that is domestic violence applicable for a woman?
We think Chattisgarh High Court has kind of answered the question where they made an interesting verdict that if a woman/wife harasses the husband then it will also be counted under domestic violence.
About the Chattisgarh Verdict:
A man resident of Bankimogra, Korba in Chattisgarh found his wife unconcious, he took her to hospital, where he found out that she had consumed alcohol and tobacco. After which, despite convincing, the woman misbehaved with the in-laws and also tried to commit suicide. Wife being an addict and trying several times, the husband got tired and filed for divorce, where in family court his petition was rejected. He challenged the matter in High Court, where his divorce was accepted.
About the Vadodara Verdict:
A complaint was filed in Gorwa police station in 2017 that a man was harassing his wife and her in-laws as well were part of it. The husband was threatening her for divorce. After having a child, the victim’s husband had an affair out of marriage. So he was sentenced to three months of imprisonment and imposed a fine of Rs. 5000. Extra-marital affair was considered as mental harassment under domestic violence by Vadodara family court.
Similarly, the section of harassment are availed for women and that is how probably we all define equality. The law is equal for everyone. There was a very interesting verdict where in Chattisgarh where a wife was booked for visiting the office of her husband and using abusive language would amount to cruelty as it upheld a Raipur family court’s ruling granting divorce to a man.
